Expands provisions of laws prohibiting reckless driving and driving while under the influence of an intoxicant or controlled substance to all premises held out to the public for motor vehicle use, all premises provided to employees and all premises provided to tenants of rental housing in buildings of 4 or more units. Eliminates requirement that a physician who determines a serious risk that an infant's bodily fluids contain controlled substances obtain the parent's or guardian's consent before testing the infant for the controlled substance. SB 117

Creates a new separate OWI offense. No person may drive or operate a motor vehicle containing a minor passenger while the person is under the influence of alcohol or a controlled substance or both. This new offense may be counted when determining number of prior OWI offenses for purposes of sentencing and license suspension/revocation. Allows a court to order a person who commits an OWI offense while there is a minor passenger in the vehicle to perform community service work that benefits children or that shows the adverse effects on children of substance abuse or OWI behavior.
