Creates a new separate OWI offense.
No person may drive or operate a motor vehicle containing
a minor passenger while the person is under the influence
of alcohol or a controlled substance or both. This new
offense may be counted when determining number of prior
OWI offenses for purposes of sentencing and license suspension/revocation.
Allows a court to order a person who commits an OWI offense
while there is a minor passenger in the vehicle to perform
community service work that benefits children or that
shows the adverse effects on children of substance abuse
or OWI behavior. (Companion bill - AB 144). Committee
